Neighbor sues over "wood smoke"

    I can't help but think if she agreed to take some steps (advice from this site or nearby members) to reduce the smoke, this could've been kept out of court. This is a classic sitution where a mediator should be involved rather than the courts.

    I love the smell of the woodsmoke. I'm sure to some it's not as enjoyable but in the big picture it's about keeping warm. I'm going to show my wife the legal arguement, I'm sure we'll chat about it.

    The entire coastline from Florida to Mass. subscribes to this type of thinking. Know quite a few of them. Its the same ,,, milk and meat come from the grocery store mentality.
    Have had many of them move out here and they don't last long. If they do ,, they don't hold many friends.

    I got a neighbor that got into it with another neighbor over a burn barrel. Did not even have the respect to talk face to face just yelled through the hedgerow. One of those I moved in and your gonna do what I say types.

    he seems like the type who needs to find something to complain about
    my new neighbors called the police on me because there was a deer in the driveway ( for ten minutes before going into the garage to hang ) for some animal cruelty crap
    the neighborhood was the same for forty years now they are knocking down perfectly good houses and building huge ones and the yuppies dont understand wood heating hunting or anything they dont like . they flock to my town for the schools use them vote for all the tax increases then move out . i fear there will be more stories like this .

    None of my neighbors are upset with my wood burning,my huge wood supply & multitude of saws.I keep my yard & property clean,burn very dry wood that is clean burning with almost total combustion,the stacks are organized & very neat.It goes both ways - if they were real azzholes about it you can bet I'd be firing up that monster Mac 125 outside their window at 5AM every morning ;) :dex::saw:

    The lawyer should b forced to prove his case by submitting air quality test done by mutually agreeable testing, and a determination that her wood smoke is the source and presents a significant health risk. If he had to pay to get that done, he would drop his suit and find another issue to occupy. This is a case that needs to be defeated.

    Agreed. Problem is that that would have to go before a judge. Where do judges originate from? I believe most were lawyers before becoming judges. Familiarity Breeds Contempt. Not to mention that the system caters to the level of justice you receive is directly proportionate to the size of your bank account.

    Some one should inform Mr. Attorney (and I use the term Mr. very lightly) that the electricity he uses does not originate from a plastic thing stuck to his wall with 2 or 3 slots in it. But then again I would bet dollars to doughnuts he thinks meat, eggs, milk and grain all originates at the local market some how magically placed in containers that are convenient for him to take home and consume. I'll also bet when he is out playing golf with his buddies he is huffin done a nice big cigar and don't think twice about the air around his friends if he has any. All that while he is walking on turf that has seen more chemicals per square foot than an average farmer here in Iowa would be allowed to apply to an acre due to ground water contamination. I am sorry for the rant but guys like this just really piz me off. I'm gonna shut up now.
