Neighbor sues over "wood smoke"

    If its legal to use a stove/fireplace , how does a judge get to create a law and apply it to one citizen ?
    The lawyer has an advantage with cheap legal costs.

    All she has to do is find a lawyer that hates this lawyer and game on. Might even do it pro bono for the "pie in face" factor !

    Ive had one of these neighbors for 20+ years. Its never been lawyers but cops,dog catcher, DEC, the whole works. I've never had a fine or court date. The last time DEC was here , the officer said to me at the end of the visit, "We are getting tired of coming out here on BS complaints, ,,,,,,, so,, would you like to know who is complaining"??? I took it as ,,,,, handle this amongst yourselves ,, don't involve us.
    10 or so years ago I told a friend of his cousin (because I knew it wood get back to him )when asked about a recent incident that he better fatten up his bank account because the next time he called the cops or whoever on me I was suing him for every reason an unethical lawyer could dream up. The law has not been here since.

    I agree with what everyone is saying BUT I think this has the potential of creating problems for a lot of us.. do to people on both sides of the issue.

    I havent seen idiots of the woodburners side on our site, but we all know them. They cut green trees today...burn them tomorrow....because they can.

    I see valid concerns for air quality with these people as greatly affecting us. Its scary because the people who are being sued sound more responsible than that.

    Education of how to burn properly and what to burn is HUGE for us to keep this right that we all love.

    This lawsuit is not only against Shari, it is against all of us.. Donation Sent to help defend my right to burn wood to stay warm..

    Luckily, this guy has chosen the wrong target.. A responsible wood burner. Hopefully the judge will see this as frivolous.

    We must continue to educate all who will listen..

    I had to stop reading the comment section. Somebody is saying you dont have a right to anything in your house or property if it bothers your neighbor lol. Doug Casey is right, America, the idea, is dead.

    I wish I had the monetary means right now to contribute to the legal fees but unfortunately I don't this time of year. The article that lukem just posted a link to pretty much sums up the whole deal though. Not to be political or anything but this woman's fight seems to be a metaphor to a lot of things in life right now weather it involves wood burning or not. I wonder why after 6 years as neighbors he suddenly has a problem with her burning wood to heat her home?

    Isn't it obvious? There's money to be made...either by taking money out of this woman's pocket...or others just like her on the behalf of future clients. Pretty clear cut to me.

    While the EPA is all over wood smoke regs and it's going so well, any chance the guvmint could also outlaw and regulate the particulate pollution called pollen? I'd appreciate it. I've noticed it seems to be everywhere in the spring and fall... :picard:

    I should sue those farmers for planting corn next to me....spreads pollen everywhere.

    Unfortunately there are hundreds of things that are regulated that you may or may not agree with. That really isn't the issue.

    What's important to learn from this woman's situation is not that it happens (government regulation) but that it does and how we can safeguard our life style from unreasonable regulations.

    It's great to be mad at this but we need to understand we have to be constructive in defending our ability to heat with wood.

    Educate the bad woodburners and non-woodburners alike.

    Lawyers sue people....to make $. That's what they do.

    If this guy was concerned purely over the welfare of the masses, I would think there would be a bigger, easier, target that would "help" more people.

    I would also think he could make more $ from other targets (the kind with deep pockets) than from a single mom neighbor...so he must be trying to set himself up by creating a precedent he can benefit from in the future. Pretty soon you'll hear a radio add in Jersey..."neighbor impacting your quality of life with dangerous wood smoke? we can help. we've successfully litigated to remove this hazard...blah...blah...blah."
