One has to feel for the farmer. He may lose the farm and that is sad. Accidents happen. Was he negligent in fencing in the pasture? Sorry, but animals sometimes are hard to contain, especially if some other animal is after them. Who would we sue if we hit a moose or elk or any animal?

Exactly my thoughts. Animals get loose. Farmers are having a tough enough time as it is without dealing with lawsuits.
A couple years ago there was a hybrid cow/bison that escaped a local slaughterhouse and was on the run for 8 months before getting captured. It actually wandered right through my uncle's backyard at one point.

There was such a loud public outcry on social media that the animal ended up on a sanctuary in Florida. I wonder if the farmer was compensated for the lost income?

That thing was a Rockstar at the time, you couldn't help but laugh at the way it eluded being caught for so long.

I do wonder about the right to farm law, but maybe all states do not have it.

In the case of the original article it was an ugly situation for all. For the person that got seriously injured and lost wages, for the farmer dealing with the lawsuit, for the jurors that had their daily lives uprooted to serve on the case, and even for the cow itself. Imagine spending your life in captivity and you break free one day, only to be mauled by a vehicle going 60mph. :picard:

No one, the State of Iowa owns the deer population here; you have to pay to hunt them, get fined if you don’t pay & have to get special permission to get a salvage tag if they are hit & you want to move the carcass after it has damaged a vehicle. They cause millions of dollars in damage to crops & millions in vehicle damage, you are entitled to no compensation from the DNR if their deer damage you or your property.

Pretty much the same is all or most states, including MI.

Funny that I remember a case in MI where a large hunt club fenced in the entire area and had to reimburse the state for the deer that was on the land. After a few years the deer started dieing so the club sued the state and won! That surprised me.

Is this a bull story?  Missed it on the news. Scary stuff.

I ran over a deer carcass on 84 in Tolland county a few years back. I was the third after the initial hit. Just some minor damage to the front bumper and hair and blood on the frame. It came up too quick when i was driving and centered the hit on the car. We pulled over and checked.

I have to wonder, who gave the STATE municipal corporation permission to claim ownership of all the wildlife? Sounds like old England where all wildlife belongs to the King.
Seriously though, I just spent this morning reading a rather lengthy text about the limitations imposed on the state by the state constitution and the people being the paramount source of all law, so I have to wonder where it is the suit and tie people get the idea they can impose such BS? What happens if one of the Municipal Corporation of Iowa's Deer defects to another state while walking through the woods, does it apply for an amnesty program or something? Inquiring minds want to know.

On another note, that news article linked lead to this. I've made the national circuit!
