ok - worked things out with the owner and tree service.. The trees come down tomorrow, starting at 8am. Yes yes.. I'll take pictures. Might even post them here. ~smile~

I'm envious of your situation as I'm in a very similar one, with much less desirable 75-100ft tall spruces (six of them, with 3 small 4" or so diameter maples between them) that are stuck between my garage and neighbor's house. She thinks they are on MY property, though two different land surveys my property has had over the course of 5 years proves otherwise, clearly. The trees are a huge hazard in my opinion, and she just doesn't agree, although she does want them gone but isn't willing to split the cost (again...they are hers) I may start my own thread with pictures to get other opinions and not hijack your thread, lol. ANYWAY...I'm glad your neighbor is actually going above and beyond the neighborly thing to do and taking on the work himself. That speaks volumes. In my mind, splitting the cost is more than appropriate, but when a neighbor takes full responsibility of THEIR property, it's really an added bonus. In my situation, if the spruces at my house were on my property, they'd be gone by now and I wouldn't have asked my neighbor for a dime. The reality is about a foot or so that determines the ownership. Part of me wants to call the town to see if the code enforcer would determine them to be hazard trees in which case she'd be ordered to have removed. But that's really a great way to make enemies with the neighbor.
