I wonder how many trees will fall tonight as a result.

If a neighbors tree falls into my yard, who does it belong to? Can I cut it up and claim it as my own?

Actually there are only a couple of trees, Poplar, that are on the wind side (west) of my property that do have the potential since they are at least 100 feet in height. The trees along the east side of my property do not belong to me, but due to their height, I would imagine could come down and trash some structures on my neighbors property. If any do fall, it might just be an opportunity for more firewood. (Potentially Poplar, White Pine, Black Locust, River Birch, and Ash)

    On another note:

I haven't taken down the 2nd Norway Spruce as planned due to the winds, rains, and more winds, but I am anticipating this coming week. I have managed to noodle about 2/5ths of the 1st Norway Spruce and split the rest by hand. I'm also processing the branches into some kindling and firewood. whatever remains will meet the chipper soon enough.

It looks as though you have a very similar forecast as this area. Then the upper 20's for a low tonight! I guess I had best keep out my insulated kevlar long undercloths in case I need to get cutting in the morning! :hair:

It was blowing snow sideways here about an hour ago. Ground is covered, 30-40 mph winds.

Stargazer I would check the local ordinances but around these parts if a tree falls onto your property, the part on the property now belongs to you, BUT most would still talk to the neighbor as is always best to live in harmony to the best of our ability.

Well if your neighbors don't burn wood they would probably be happy for you to cut the wood up and take it

Well, our Bradford and our neighbor's survived....
A coworker called at 11 am this morning and asked me to come up to his mom's- next block up from us- 2 Bradford's destroyed; I had to decline cutting them up for her as I'm not totally ready to run the saw
(physically 65-70% STILL:hair:), and I don't want to damage myself before getting to attend Backwoods Savage's GTG in a few weeks!
But I'll tell ya's the impulse to make some chips fly was STRONG :saw::saw::saw::saw:
    :headbang:

In Pa, any part of a tree, on your property, or hanging over your property, is yours.
And If your neighbors tree breaks and falls on your car...your car insurance covers it, not your neighbor's homeowners

I took a peek to see and it seems to be a common theme across the states. Rather than try to explain it, here is one article that kind of puts it all in perspective.
Who’s responsible when a tree falls?

Basically it boils down to negligence. If the trees in question are Poplar and White Pine for example, it could be said that it is negligence since these are known brittle trees. However in that type of case the courts would have to decide if there was damage done to your neighbors property from one of your trees.

For me, I would look at it as a firewood opportunity if their tree fell on my property, (whether it caused any damage or not) especially if the neighbor didn't use wood for heat. AND if any of their trees fell on their property causing damage to any of their buildings, I would look at that as a firewood opportunity as well.

Where I live, any trees on my property that could have caused any damage to my home or buildings have been removed (by me) because I know what high winds can do. Add to it the fact that most of the ones I removed were sick and dying anyway, or were a hazard trees. Now my neighbors trees I'm not all that concerned about, well maybe a little at the back side of my property, but most do not have the potential of doing any serious damage to my property.

However, my neighbor should be concerned since the prevailing winds come from the west and southwest which could easily damage or even destroy several of the buildings on his property. He may ultimately be faced with having those trees removed before they have a chance to do any damage by either hiring a tree service and getting it done (and I would ask the tree service to dump the remains on my property) or asking the old lady that lives next door (me) to remove them. Either way, more firewood for me.

I was going to present an offer which would benefit him and his wood burning relative as well as myself, but he was talking about selling off that portion of the property recently so I decided not to present an offer.

I'm glad your Bradford's were spared, but remember, they are known weak trees.

If I were in your position as far as healing goes, I might be tempted to pick up a light weight saw like a top handled arborist's saw and go have my way with your co workers mothers trees. Then just have someone else pick up the rounds and limbs. But that's just me. Heck, after my double back surgery, (opened from the abdomen and back) I was out riding my bike within 6 weeks. I found out later I wasn't supposed to attempt riding for at least a year, possibly longer. Oooops!

You did the right thing in fighting the urge at least until the GTG. I'm weak since I know I would not have been able to resist.
