Got in a accident with a non insured driver

    and why did the air bags not go off on the other persons car?? or mine for that matter as we have side impact bags on it as well

    Maybe not enough speed. I forget what the amount of impact needs to be. Id be pizzed too, im only reading this and im pizzed! So many losers out there! :headbang:

    Not that this makes any difference.......I leased a 2008 suv in late 2007, my mechanic sideswiped the entire drivers side of my new ride with oddly similar damage to you your wifes new ride, my air bags did not go off, though I was only going maybe 10 mph max. Make sure insurance repairs the (parts) in the pic where you showed the door open, my insurance tried to skate on it but I guess it needs to be intact for safety.

    Glad no one was seriously injured. Good luck sorting through the mess. It sounds like a nightmare. This is were you find out if your agent is worthy of your business.

    That's how you'd think it would be but unfortunately it isn't. My mom had her car hit in a parking lot and the loser left. Her rates went up.

    I am hoping they replace both the doors and fender on my car and not try to repair them somehow, although the damage on the rocker well have to be repaired / not replaced

    @Elderwelder I feel for you. I went through something (not exactly) similar last year and I was sure going to get the short end of the stick one way or another. Cost me a bunch of stress for a couple months. In the end, it all worked out fine. Hope this gives you a little ray of hope.

    My dad T-boned a Ford Ranger going about 40-45 while towing his 18 ft bass boat.Everything was totaled and his airbags never went off! 3 days later the Feds showed up at the tow companys lot inspecting his truck.

    Couple different comments on this one.....Each state is different but here in Ohio insurance follows the car primarily, in other words the owner if they had insurance on the car it would cover the loss first. Drivers insurance if she had any would be secondary.

    Air bags likely did not deploy because it was a glancing blow not a dead on hit, air bag sensors are an inertia switch. BUT, I have seen several that should have deployed and didn't.

    Just from the pictures I would say fender and frt door will need replaced and rear door and rocker repaired.

    Your carrier should subrogate against any insurance that may be present first and then against her on a personal basis.

    Best of luck to you and hope the Mrs. is ok other than a little sore.

    I think I am going to be on the hook for my $500 deductible for the collision portion of my ins. since other person does not have any ins and it was their fault. :mad:

    That's total bs on how so many people have no ins and when they do get into accident nothing happens to them. Their car should be taken away..hope the wife feels better.

    It could be different for you but here in NY, I had to pay my deductible and it was refunded to me after my ins co recovered it from the other drivers ins. Your ins co should go after it from the driver of the other car, regardless of whether or not she had ins.

    Don't hold your breath though as the process can drag on for months.

    I have to take the car in tomorrow afternoon to the auto body shop for estimate / evaluation, I went down to the cop shop to get a copy of the police report, they said i need to go to the other side of town to a different building where records are so I well do that tomorrow after i get out of the body shop

    I just want the report to see what it says as the cop already told me he is submitting it as other driver at fault and issuing a citation for no ins

    My agent told me the car well be fixed under the uninsured motorist coverage on my policy and not the collision coverage. collision coverage is a $500 deductible where the uninsured motorist is either $100 or $300 but either way i am going to have to pay out of my pocket

    so my ins companies claim adjuster guy just called me, told me my uninsured motorist coverage well indeed kick in here and my deductible is $100 on it and to go ahead and get the car into the shop
    they well attempt to go after the person that hit us for the repair cost of my car and my $100, but he said dont hold my breath

    also even though I do not have rental coverage on my policy it is covered on the uninsured motorist section on the policy for a compact @$21.50 per day, I pay upfront and they reimburse me. Can I even get a car for $21.50 per day?

    I dont really have to get one as wife is driving my Nissan Frontier now, and I am left with my '87 Yota 1 Ton Dually Flatbed to drive to work and back. but if they pay for a rental I may as well take it
