Got in a accident with a non insured driver

    Bought the wife a new to us 2012 Toyota RAV4 with 31K miles on it on Halloween, wife was driving today and got in a accident with a women who had no insurance and i think no drivers license . women was in the turn lane when wife was driving up the road, women could not stop as was icy and plowed right into the drivers side of our car
    Cops came took a report,cited other driver for no ins and told me to contact my ins company
    luckily i have full coverage and under insured motorist coverage as well. but somehow think i am going to get screwed on this

    Ugh... Mmmmmm that sucks.... Yea, very likely you'll get screwed, cause to recover anything will take leg work I'm guessing.... Good Luck....

    That SUCKS................glad your bride is okay. Should not your insurance co. fix yours and then go after the other driver?

    yes, I believe that well be the case, I am just hoping my rates dont go up because of it. dont think my ins company is going to be able to collect anything from other driver, she had no I.D. on her no ins on car, car was not registered to her or owned by her, not even sure she is here legally

    Was the car insured ? My vehicles are covered by whom ever drives them . glad your wife is OK .

    Samething happened to a buddy at work he found out who owned the car . the person driving did not have the information but the car was insured . which in his case covered his loss.

    If your wife was not at fault, your rates should not be unaffected. The insurance companies have a central fund to cover them for having to pay on uncollectable losses.

    thats just it
    when I got to the scene ( wife called me) she showed me a title and registration for the car that did not have her name on it, said it is insured by the owner on the title and if we called him he would cover our car. i told her go ahead and call him. I am calling the cops
    well than she says she just bought the car and has no ins, car is out of Oregon. she told the cops about 3 differant stories of when she bought the car and why it was not insured
    I took all the info off the title and well give to my ins co

    I don't know how she had current plates on without insurance. Been there and done that. A tractor trailer pull over on my wife who was driving a large station wagon. Turned out the driver had let his insurance expire. It was the truck trailer which hit us and was insured and that is how we recovered. I didn't carry collision at that time. It was a used car, paid for. My insurance company didn't offer any help or direction. I didn't do that again. Too risky. You have a picture with the plate on that car. Offer that to your insurance company. Good luck.

    cars are off the main st in that pic,
    It was more like a heavy frost than ice in that turn lane, it has been cold and it was in the shade . i also blame her inexperience to drive in these cold conditions

    yeah, I got the plate and the info off the title.
    Turns out when I look at the "exchange of information" form the cop gave me it has her listed as vehicle owner, not sure how they came to that conclusion. i did hear the cop ask her why she has not transferred title yet. So i think she bought the car and did not bother to transfer anything or get ins on it

    That's tough. Thank god the wife is ok. The car can be replaced. There are so many cars out there that have no ins. Scary ...hope everything works for you pal

    Im glad your wife was ok, unfortunately things like this happen often, and we, the responsible ones pay for it. I hope somehow your insurance co goes after the driver and/or the owner. They are liable, insurance or not, and should be forced to be held accountable. Good luck! :rolleyes:

    the other lady had a small child in the back seat also, the child was in a rear facing car seat so that was good

    yes no one really hurt, although my wife is mentioning something about a little leg and abdominal pain now. cops have it on the report that my wife was having a little abdominal pain at the scene, told them if it get worse we well go to see doctor

    I am well insured on the our car and it well get fixed, it just pizz's me off that other driver had no ins and all she got was a ticket. hell she probably wont make a court date or bother paying it
